    Contempt of Court After Divorce
My question involves a marriage in the state of: Arkansas
5 almost 6 years ago my husband recieved a divorce from his wife of 10 years. He was ordered to pay for a car of her choice until it was paid for carry the insurance and pay all yearly taxes on it. But almost a year ago he became unable to pay for the car and it was repossessed. However the day it was repossessed he cleaned out my personal belongings out of MY car and handed it over to her to keep my husband out of jail or so he thought due to her screaming if I dont have her car in my driveway by am 6am he was going to go to jail. So stupidly with out doing any research he took it to her. My name was also on the car title as well as his. This happened it OCT of last year. Now 3 days later she took my car and traded it in with the same place we bout it from bc it was also up for repo and she bout her own car. My question is; is there a statute of limitaions on contempt of court or at any point in time can she just say hey im gonna take him for the 10 grand he owes me for a car or will the judge throw it out if its been so long? Also is there anything that I can do court wise for her giving my car back to the place it was purchased from? She was given my car with out my permission. But I dont want to get my husband in trouble. Im just curious bc if there is something that I can do about my car I need to do it.

There is no contempt for making your ex-wife whole. Your old car is gone and you have your hubby to thank for that.

Let me re-phrase the question. In arkansas is there a time limit for filing contemp of court charges? It has been 9 months since the car got repoed. Can she still file since it has been more than 90 days and she has went and bought her own car

    Yes, she can file.

How the court will deal with the petition, we cannot guess.

How the court might deal with it could have all kinds of factors involved. Your husband was supposed to buy her a car, that she could drive for a certain amount of time free of cost, and when the payments were done it would have had a value of XXX. She could have either continued to drive the car or could have traded it in on something else at that point. She didn't get the full amount of time driving the car without cost, and we don't know how the value of the car she got to trade in would have compared with the value of the other car, fully paid off. It may have made her whole, it may not have made her whole, she might have come out ahead. The info simply isn't here to determine that.

There is certainly nothing that you could legally do about your car without getting your husband in trouble, since he obviously turned over the necessary paperwork to her for the dealer to accept it as a trade in. If anybody did anything wrong it was your husband, not her.
