Entering on a Tourist Visa After Marrying a U.S. Citizen
Hi, im a romanian citizen and i just got married with an US citizen. The marriage took place in ROmania,the country were we live. We want to move to US and i want to know if i can go to US with my touristic visa(that i already have) and aply there to the green card being the wife of an american citizen. Thank u

If you intend to immigrate, you should do so through a spouse visa. By entering on a tourist visa you're promising to return home.
If you're asking "...can I get away with", I suggest you consult an immigration lawyer. If you're determined by the USCIS to have committed fraud to enter the U.S. you can be deported and barred from reentry.

Thank you for your answer,I will aply for a spouse visa but I don't want to wait in romania that's why I need to know if I'm alowd to aply in US and stay there to wait the answer! Thank u very much

A spouse visa permits you to enter the U.S. as a spouse. You thus must obtain it before you enter the U.S.

What you want is contrary to the rules governing your situation. It is in your best interest to take the time and follow the rules. You and your spouse can immigrate one the paperwork is processed and other requirements are met.

In fact, you stand a good chance of being denied the tourist visa or entry on that visa if it is found out that you are married to a US resident and would apparently have immigrant intent.
