    Arrested for the Second Time for Shoplifting
    My question involves criminal law for the state of:
    2 years ago I was arrested for petty theaf and had to go to court, my case got dismissed because I didn't have a record so they gave me a chance. A week ago I went to CVS and I mistakenly took some make up, and it was a mistake because I meant to pay for them but I was carrying too many things to the point I was dropping some of the stuff I was carrying so I put some of the stuff in my bag while I got a basket. I went to pay for the stuff in the basket (wich added to be $51)and forgot to pay for the things I had in my bag when I walked out the alarm went off and I was approched by security I then knew my mistake I had forgotten to take things out and pay for them, security said they believe that I forgot to pay for the things but they had to call the cops because the amount was too much ($73)I offered to pay for the things because I had no intention of stealing them I even had $700 cash on me.I did t want to go trough the agony of court all over again. I was again arrested finger printed. I'm scared that the courts won't go easy on me because its my second time arrested for the same thing. What can I do?

    First thing you might want to do is, supply the state in which the offense occured.

    Second thing is, get a lawyer.

    You probably know the drill by now: Court costs and fines. Civil Demand. The judge will not be very lenient this time.

    Getting into an anti-shopllifting class or shoplifters anonymous would be a good idea.

    That's what I'm afraid of but in all truth I didn't mean to steal those things. I'm just scared because the court day is so close to my wedding I just want to get over this already. I'm soo mad at myself for putting myself in this situation its no ones fault but my own I just hope the judge will give a a se ond chance...

    The judge has given you a second chance already.

    A lot of people use the "I had my hands full, so I put them in my purse and forget" excuse. So you definitely need a lawyer to help.

    That excuse will not work. There are baskets at the entrance of every store for the shoppers' convenience. I have see the use of an excuse just like that irritate a judge - it only made things worse.

    Like the judge will think:
    - You could gotten a basket at the beginning.
    - Once you realized your arms were getting full, you could have gotten a basket.
    - You could have left stuff on a shelf while getting a basket (you probably had to put stuff on a shelf while opening your purse anyway).

    Okay let me give u guys more details of what happened I got out of work and stopped by cvs still wearing my unifor I work as a waittess in a restaurant my name tag still on. I know a lot of the employees there and they know me... I go there often and the go eat where I work often. I went in only with the intent of buying hairspray and body wash but they were having a sale in make up where u buy one get the other half off so I deceided to also stalk up on some makeup since they were having a sale. I grab 2 concelers 4 foundations I was already caring the 2 body wash that were on sale too when I was walking I dropped on of the foundations and one of the employees was passing by and I asked her for a basket she told me the were in the front by the chips so I put some of the makeup of top of my bag while I went to go get the basket (yes i know stupid of me) I continued shopping I also purchsed a dry shampoo and a leave in conditioner( also on sale) and I completely forgot about the make up I reached in my bag for my wallet(didn't see the makeup because at this point the makeup had made its way underneath my make up bag I payed for the things in the basket. Wich the total was $51. When I walked out of the store the alarm starting going off and I even opened the the bag with the things I purchased to see if they forgot to remove a security code I was even urning around to go back when the security asked me to fallow him to the back I then remembered the other makeup I asked if I could mm pay for them and he said that yes. But when we got to the back he told me he had to search my bag I told him it was fine and that I had money to pay for the things wich I did $700 on me. He said depending on the total amount of the things taken it would depend if the police were called. I asked what was the acceding amount and he said he couldn't disclose that. When the maneger came back with the total wich was $73 he said cops had to get involved. So he called the cops and the arrived 30min later in that time they made me sign a paper that said I couldn't trespass or else I would get a fine or go to jail and the made me sign a letter where it said I had to pay restitution to cvs I sign cuz I just wanted to get out of there. The cops.arrived handcuffed me and gave the security a hard time for not giving me a chance of paying for the stuff. He then placed me in the back of the car. Where he continue to tell me that guy was an asshole for what he did to me and that I should sue the company. He said he couldn't let me go cuz he would loose his kob if he did so they took my stuff search me and booked me but I was never read my miranda rights. I don't know if I should of. Either way don't want to get the officers in trouble because they were really nice to me. I have court on the 23 of august and scared because its my second time arrested the first time charges were drop but I'm mm ot too sure ill be licky this time. If it helps bouth the cop and security said they believe that I forgot to pay I just hope they put that in there report.

    None of which changes the fact that the police, the DA and the judge have all heard that same excuse too many times to find it creditable - even if it's true.
