16 and May Be Pregnant by 18 Year Old

My question involves criminal law for the state of: Wisconsin

I have been seeing this guy for almost 9 months and I am afraid I may be pregnant. I am 16 and he is 18. Our age difference is 1 year and 9 months. Is there any way for him to not get in trouble if I am in fact pregnant?

SideNote: My mom and dad are divorced and I live with my mom. My mom knows about me and him but my dad does not. Neither know I may be pregnant.

948.09 Sexual intercourse with a child age 16 or older.

Whoever has sexual intercourse with a child (that's YOU) who is not the defendant’s spouse and who has attained the age of 16 years is
guilty of a Class A misdemeanor.

There is NO "Romeo and Juliet" exception in Wisconsin law. If you are pregnant, he can expect a criminal charge (Wisconsin, Florida, and Texas are among the harshest states when it comes to adults having sex with children.)

So there is nothing to save this situation?

Well, you can pray that the DA is too busy to address the question.

But if you are asking whether there is any other law that will void the one above, or if there are any extenuating circumstances under which the law above does not apply, the answer to both is No.

It means that saying, "but I consented" or "but we're in love" does not magically make it legal.

So could I just say I don't know who the father is? Then the question goes away.

And do you think anyone will believe you?

I don't really talk to anyone, and my family that knows could just keep it a secret. I mean, not knowing who the dad is can be believable.

You've been seeing the same guy for 9 months, you turn up pregnant, and you don't know who the father is. Oh, yeah, kid. That's really believable.

The time to worry about whether your bf was going to be in any legal trouble for impregnating you was BEFORE you spread your legs. Too late now.

No, not only are your parents NOT the only ones who can report him, your doctor is a mandated reporter.

I think that there is some doubt on that one. Yes, doctors are mandated reporters but they are also mandated to keep reproductive issues, even for minors, private unless they have the consent of the minor to disclose that information. They cannot even disclose reproductive issues to the minor's parents without the minors consent. Minors are emancipated in that context and that context only.

Those laws were put into place to ensure that minors would get prenatal care...because of course, if the minor were afraid to go to the doctor, and therefore afraid to get prenatal care, the infant to be would suffer.

so it is unlikely that anything will happen to him unless someone reports it, right?

We don't have a crystal ball, so we can't predict the future. ANYONE can report him, and SOME people who may find out about it would be REQUIRED to report him to authorities. Bottom line being that he's already committed the crime, and the future hasn't occurred yet. He's already dug a hole for himself that YOU won't be able to help him out of - concentrate on yourself and having a healthy pregnancy.

How can I only concentrate on myself when he is my potential baby's father? If anything it's my fault cause I missed a couple of my pills and the condom broke. I know we shouldn't of been doing it in the first place but still.

I understand that you are looking for someone to tell you that he is not going to be in any kind of legal trouble.

We cannot, in honesty, tell you that.

HE is the legal adult. HE was responsible for not committing a crime. Was it careless for you to miss a pill? Yes, it was. Did you commit a crime? No, you did not. HE did and HE is responsible for that. HE is the one who never should have been diddling a minor in the first place.

Unless this child is planning to drop the baby in a field somewhere 8 months from now, sooner or later there is going to be a doctor in her future. Of course, the cat may already be out of the bag as to the pregnancy (and most likely thus the perpetrator) by that time, but it doesn't change the doctor's responsibilities.
