Caught Stealing from My Employer at a Different Location
My question involves criminal law for the state of: Colorado

I tried to steal from walmart. I work there, but I did not steal at my store, or during a work day. I went to another store that was farther away. I am going to be loosing the house, so I broke down and decided to do this. I used some stickers to change the price of two items. ( $199, and $44.88 ) then I stole two things both $130. These were pocketed. I did use a Alpha S3 Key to unlock a box, and when they found it they told me it was going to be burglary. I guess they said it was because of intent with the s3 key. ( I got the key online if you must know ) Anyways the total came to $510, and I was arrested. Please let me know what you think I might be facing? I am 29 years old, clean record. Not even traffic. Disabled veteran as well, and broke. Do I have a chance to get a lowered sentence? Can I work something out with the store to bring down the charges? Maybe volunteer, or work community hours? Thanks ahead. Also they thanked me for being nice, and co-operative. I told them everything, I worked for the company, were i got the key, and where i was going to turn the product. It was written in the report that I told the truth and worked with them, even the police did the same in theirs. Does this matter?

I can guarantee that the WalMart you work at will be notified and you will be fired. You likely won't be able to collect Unemployment.

You will want to retain a Criminal Defense Lawyer. If you can't afford one, plead "Not Guilty" and ask for a public defender. Be sure to ask about a First Time Offenders program.

You can expect court costs and fines. Other things that may happen include an anti-shoplifting class (which you pay for), Community Service.

And the store/it's lawyers will be mailing a Civil Demand. This is separate from the criminal case. If you don't pay it, they can sue you for even more money; still don't pay and it can be reflected on your credit history.

The high value of what you have stolen shows this is NOT the first time you have shoplifted, just the first time you have been caught.

All in all....expect this to cost you several thousand dollars.

A for-profit business would be breaking the law themselves to allow you to volunteer. Community service is not the store's call. For that matter, what you get charged with is not the store's call.

This is the first time I went shoplifting, and its kinda of unfair to say something like this, based on a number. I really do not know why I did it. I am diagnosed with severe social mood disorder, and PTSD. I have symptoms that include tunnel vision, high anxiety, extreme behaviors ( spending lots of money, careless driving, random acts ) I have been on medication but recently I have been waiting to change to a different medicine. I havent been on my medication for the last month. I am Methadone, Valium, Ritalin, and Wellbutrin ( switching to xanax ) this all comes from the military. I had the key from a couple of months prior because I had urges to steal, but I never commited the act. I did talk to my therapist about it earlier. and during our convos I ended up scratching the idea. Does this have any impact on my outcome? As its a mental health issue.

No impact because so many people have tried it. The fact is, you stole, you planned to steal, you are old enough to know doing so is wrong.

Agreed unless you spend big bucks on a defense team and expert witnesses.

Did you tell them you worked at Walmart in a different location?

O.P. said in the first post that she/he did tell the Walmart LP and the police.
