Caught Stealing at Wal-Mart in Texas
I do not want to hear how stupid I am. Trust me I am saying that enough right now to my self. I am 27 and have NEVER BEEN in trouble before. I am also a teacher and am going back to school. I was caught stealing at Wal-Mart. Money has been extremely tight and this were things that I really needed. They took me into the LP office. He called three other employees in there. It was under $25 so they said that they were not going to call the police. They made me fill out my information. DL SS , phone number and address. They had me sign a paper saying that Wal-Mart would call me in no more than 2 weeks or I should call them. They said that Wal-Mart is going to sue me. I called the manager back and he said that if the police were not called then I would not be arrested. He also said that it would be handled between me and the store or home office. I do not know what to expect. They said I would be receiving a fine. How do I pay this? Will it be Wal-Mart or a law office? Can this go onto my record? Can they decide later to prosecute me? Does Wal-Mart have to keep this confidential or can they give out my info and what happened? Also do I need to get a lawyer? I would like to keep this to myself as much as possible.
Walmart did not say I was banned. I am going to stay away for a little while but I am worried about going back ever. I am from a small town and walmart is the only store. Am I banned?
I know this is alot. I am confused and scared.
Re: Caught Stealing at Wal-Mart in Texas
If you go back, they may call the police and have you removed. That will look good in the police blotter. Walmart does not need to keep the info confidential any more than the police would. If they only send you a civil demand, pay it and things should be over as long as you are not caught again somewhere. You will likely be in the retail theft database now. If the police contact you, you need a lawyer. Do you really think you possess the moral character our children should be exposed to? How are you going to respond, when one of your new students recognizes you because they saw you getting pinched by store security? Your new co-workers? Your neighbors? Your relatives? Well your relatives will likely only talk about it behind your back.
I wonder which of the 5 licensed teachers in TX you are.

With money - generally a check or money order.

Will it be Wal-Mart or a law office?
Yes... that, or a collection service.

Can this go onto my record?
You mean, can Walmart keep a record? Yes. You mean, if you signed a confession, can Walmart potentially report your confession to a service that tracks shoplifters? Yes. You mean a criminal record? If the police and courts are not involved, there would not be a police or court record.

Can they decide later to prosecute me?
Yes, although in my experience if they say, "We're not going to charge you", they're not going to charge you. You could trigger a change of heart if you don't pay the civil demand, but I venture into the realm of speculation.

You tried to steal from them, were caught and confessed. There's no reason they need to protect your privacy.

To pay a civil demand? No. In the seemingly unlikely event that charges are filed? Then it would make sense.

I'm curious, then - is your name actually Leah Z. Davis? Because....

The decision as to whether to ban you is theirs, not ours. If they have not told you not to return to the store, you've given us no basis to conclude that you were banned - but we only know what you tell us.
