    Can You Get Extradited for Drunk Driving, Probation Violation
    My question involves criminal law for the state of: New York

    I fled the country when I picked up a new DUI charge in New York. I was already on felony probation for a previous DUI- all are non injury relate, non property damage related. My question is that everything I have read seems to suggest that I should be okay to fly in as long as I fly in west of Mississippi, since it is non a serious grade felony. Does anyone have additional info or experience in the knowing the pick up radius for such charges and subsequent warrants?

    You can be arrested and detained anywhere. They can hold you for 2 or 3 weeks, to allow the jurisdiction time to determine whether they will pick you up. There is no magic "radius". It is dependent on the facts surrounding the issuance of the warrant and desire of the court to get you back.

    The ONLY person who can give you an accurate answer is someone actually LOOKING at the warrant. Anything else is pure speculation. The pickup distance can vary due to lots of different circumstances, so even on two similar cases the distance or even IF they'll extradite at all can be different. There's not a "chart" of distance that functions that easily.

    Are you a U.S. citizen? If not, when you choose to commit crimes while you're a guest in another country, then choose to become a fugitive instead of taking responsibility for your actions, you send a pretty clear message to that country that you're an undesirable person. If a warrant shows up in a USCIS check at a port of entry, even if they don't detain you for prosecution, they can tell you to turn around and go home.

    You are absolutely subject to being arrested on that warrant anywhere in this country and at any time. If you are arrested in another state the only question is whether the issuing jurisdiction will pursue interstate jurisdiction. Until that decision is made and acted on you will be held without bond at whatever location you were picked up. If you are not extradited the first time this can happen over and over again (since FTA and VOP warrants do not expire) until you are eventually extradited or surrender.
