Emancipation in Arkansas for a 16 Year Old with an Abusive Family
OKay, I am Almost 17. And I need to be emancipated ASAP because my family is verbally and sometimes physically abusive towards me. I have my GED, I am Starting college in the Fall, And I am Trying to Get a Job. I have A Place To Live And I get 835$ a month from death benefits. I don't have very long to get a plan together, so I need to know something NOW!! Oh, And I am also on probation for juvenile curfew violation. Pleaaaaase Help And Tell Me the laws and rules and How I can do this or if there are any other options for me.

You will not qualify for emancipation.
If you're being abused, call child protective services.
(And you realize that emancipation = goodbye death benefits, surely?)

No, It Does Not Mean That. I've ALready looked up social security stuff. And Why Wouldn't I qualify. I have A diploma.

Yes it does. You currently receive DEPENDENT benefits. These WILL STOP if you're no longer - that's right! - a dependent. And that's exactly what emancipation does - it renders you INDEPENDENT.
Of course if you'd care to show me otherwise?

Courts emancipate minors who have demonstrated responsibility and, who through no fault of their own, are already effectively living on their own and for which emancipation will be in their best interest. Emancipation is NOT a means to avoid nagging parents.
And, no, you do not have "a diploma," you have a GED. While they have much the same effect, they are not the same thing and some GED programs are not accredited. Hopefully you took yours through the school district or an approved county program. If you are probation and had to complete a GED (presumably because you were no longer attending school), I can assume that your school career was less than stellar as has been your citizenship. These qualities will not make you a likely candidate for emancipation as they tend to show a lack of responsibility.
As for death benefits, those will end once you are 18 and out of high school. So, that money will go away in a few months. Without it, how will you live?

Even without the many other reasons you don't appear to qualify, THAT is reason enough for the court to deny your petition (unless you're able to prove that the reason for the curfew violation was something completely beyond your control - such as the city bus you were taking home from your job broke down, causing you to arrive home late).

Social Security (and V.A.) survivor benefits do not end for an otherwise qualified minor as a consequence of emancipation.

But, at 18 and out of high school they end. So sometime in the next few months they will go away.
