My question involves guardianship in the State of: North Carolina. How does my 15 year old go about emancipating herself from her father. Right now we do a 2 week rotation (since she was 2).
First of all, fifteen year olds in the state of North Carolina cannot be emancipated. Second of all, even if they could, she cannot get "emancipated" from one parent, but not the other. Third of all, is this schedule court ordered? If so, your job is to make her go and see her father. If your question is about terminating Dad's rights, it sounds like he is a pretty big part of her life at this point, so that won't happen either.
As long as there is a court order that she go to Dad's, she goes to Dad's.
You are free to file for modified visitation. Your likelihood at success may vary.
