Can I Get Emancipated at 15
Can i get emancipated at 15 here in Texas? I want to get emancipated from my mother and step father. We have 6 people living in a 2 bedroom apartment the only people with a real bed is my mother and stepfather. I believe they are unfit to raise my brother nephew and my self. My step father threatens me and my 16 year old brother. A couple months ago my step father also pinned my brother against our couch and was chocking him. my mother is mentally and verbally abusive she has also chocked me and my 27 year old sister and pined us against the wall (at different times). My 3 year old nephew has been witness to these fights and I don't believe this is a good environment for him to grow up in. My step sister has hit my nephew with a shoe in his back. I'm scared for my brother, nephew, and mine well being. A couple (maybe 3) of my friends and uncle have witnessed many of the fights my family has had. I wanted to know if I am old enough to get emancipated and if that (whats written above and the witnesses) is enough evidence to prove that they are unfit.

    Not in a million years.

If you're being abused, call child services.

And please, do us a favor. Read other threads about emancipation. You apparently don't understand what it is.

    Not gonna happen.

First of all, only two states will even consider emancipating a 15 year old; neither of those states is Texas; and you do not qualify for emancipation in either of them anyway.

Second, emancipation is not and never was intended to be a means for a minor to leave home; it was and is intended to be a means to provide legal protection to those minor who, for reasons outside their own control, found themselves living on your own.

In your state, emancipation is not possible at 15, and at 16 is only possible if you are ALREADY living on your own. Not with other relatives, on your own.

You absolutely have grounds to contact CPS, or to talk to a trusted teacher, pastor, rabbi, counselor, doctor, nurse etc., who may have alternate solutions. But emancipation ain't going to happen for a minimum of two years, and most likely not for three.

Ahhhh summer, when all the children who hate their parents, think they can be adults on a whim and a prayer.
