    Wrongly Included on a Rental Exclusions List
    My question involves landlord-tenant law in the State of: Texas

    I am applying for a rental lease in Texas. My name came up on a list of Rental Exclusion List from 2004. I contacted the local County Courthouse and they said the case is past 7 years and they have no history of it being dismissed (which I am stating). Can they keep me on this list 9 years after the fact and it's not even on my credit report anymore. It was but it was removed. What to do and can they deny me ?

    If by "the case is past 7 years and they have no history of it being dismissed" means that your prosecution is showing up in the court system as an active case, then presumably it's being reported as an active case. Clarify what the court told you.

    I contacted the court and they have no record of it. I asked for a printout and they said they can't print something that is not there.

    They have no record of what? If they show an active charge, with no record of dismissal, then that's what's being reported.

    NCS is showing an outstanding balance but my credit report shows nothing and the courts are showing nothing.

    If no case was ever filed, why are you talking about lawyers and dismissals?

    Go visit the courthouse records room and look for your name on the case index. Then look at the paper case file or microfiche.

    Courts keep archived case records a lot longer than 7 years even though they might not have it on the computer longer than that.

    Did that. They have nothing and it is not on my credit report. It may have not even been a civil claim but it still shows on there books. They know I need off of this list and are only willing to take 60% of the $2994.00 that is 9 years old. I disputed owing anything upon moving out 1 month early because of a neighbors boyfriend driving his car through my garage and they said they were not evicting her and him so I moved out for my safety. 9 years later its biting me in the behind. NCS is the negotiator for United Dominion which bought the debt for nickels on the dollar back in 2004. How can a property keep me on there Rental Exclusion List when they sold the debt off 9 years ago ?

    National Credit Systems, Inc does not have you on a rental exclusion list if your debt is over nine years old. We do not maintain rental exclusion list ourselves.
