Recording Public or Private Conversation
My question involves criminal law for the state of: WASHINGTON
Can I record a neighbor and his wife yelling at me and having a yelling conversation with me, we were all outside, they were on their doorstep outside while I was up on the street walking about 175 feet away? I was wearing the recorder outside of my clothes where if they were close it would have been easily visible.
I know Washington says all parties must consent or two party consent, but there were 3 people involved AND it was outside and anyone could hear the conversation outside as it was loud and yelling.
Can I do this legally?
Re: Recording Public or Private Conversation
If you were on a public street and you could clearly hear what they were shouting from 175 ft away, I think it is safe to say that it was not a “private conversation” or that they had any reasonable expectation of privacy.
The applicable RCW is here.
