    Michigan vs California Child Support
    My question involves child support in the State of: Michigan and California.

    I am a resident of Michigan, I was in the Air Force but am in Afghanistan as a contractor now. My ex wife moved to California since the divorce. She now claims she can get the child support case moved to California from Michigan where she says she can get more money as well as alimony. I am still a resident of Michigan and i have never missed a payment, and the case just went to court last week and there is a brand new CS order (this is what makes her mad) she never updated her address with the court in MI and she claims I am cheating her out of her money somehow. Is it possible for her to move the case to California without my approval? If so, can she get alimony even though the divorce was a Michigan case where there is no alimony?

    Oh HECK no. Fight this tooth and nail. She doesn't get to "forum shop" like that.

    Are you saying she is unable to do this, or just that I should fight her trying to do this?

    She can't do this, no. I have no idea what she's telling you - have you actually been served with anything?

    If she wants to reopen the divorce, she needs to do it in Michigan. She can't just decide that California is better for her and expect CA to award her alimony!

    She was saying she has a lawyer and the lawyer was telling her she can move the case to CA since that is where the kids are living. I was under the impression everything would have to run through MI for the entire time until the kids were 18, unless BOTH of us agreed to move it someplace else. Sounds like that is true.

    Golden Rule, Dad! NEVER listen to your ex when it comes to legal stuff!

    Now, she may be able to get the case moved based on inconvenient forum but that does NOT mean she can reopen the case and ask for more money in CA.
