Modification of Child Support in California
My question involves child support in the State of: California

I'm currently under somewhat lenient orders and I share 50% custody with our daughter’s mother. My question is; If I move and settle into my own residence, can the mother still come back for more child support stating that I make too much money? I would assume yes but what I really want to know is, if I provide my expenses will the courts take that into consideration or will they only look at what I take home???

Your expenses won't be considered. They're going to look at both incomes.
Is Mom working?
Is there currently a order of CS? If yes, has your income increased?

Yes, there is a current order in place and yes my income has increased from unemployment to having one full-time occupation and two part time employments. The mom only has one job (working as a cashier at a national drug store) She has not shown any means of improving her situation what-so-ever. I now have three incomes, volunteer my spare time to the homeless and chemically addicted, on the board of directors for a non-profit and I’m going to school full time to better my ability to care for our child and myself.

Then Mom has every right to file for an increase in CS.

That's just how it is. Your original order was based on what you were earning then. Now your income has increased - hence your obligation will likely increase.

So cooperating and being a "nice guy" while on unemployment (meaning, when we did go back and was modified because I was laid off, I could've had the mom pay me child support but didn't (for two years!)) will not have any value in the courts eyes? Nor will the fact that I am now 7yrs clean and sober, going to school and making the attempt to improve our daughter’s situation? Not just my situation but to better our daughter?? I have busted my behind to turn my life around and the mom has been stagnate... All the positives I have accomplished are of no meaning? My life improvements have been leaps and bounds! I'm so close in finally having enough income (in Orange County, Southern California) to finally rid my two room rental with room-mates and have a place of our own and this will have no barring with the courts? This is discouraging...

The courts really don't care about your expenses - they expect you to support your child/ren per the state guidelines. They also expect you to live within your means. If you move to a more expensive home, you best be able to afford it plus a possible increase.
Have you run the numbers through the calculator?

Yeah, and with our current orders I'm barely living at all. Just inching ahead to be able to move into a place of my own and with this good news you deliver, waiting for the other shoe to drop and take that away... Our daughter's therapist is on board with mom not upholding her end of parental guidance BUT will not move forward without a life changing event (ie: DUI or something in that magnatude). Even with our daughter telling the therapist her mom drinks and does not uphold her commitments... Dude, thank you for the clarification... Even my attorney says there's nothing we can do until the mom really messes up. Ugh, doing things 'by the book' is supposed to work but in reality, IT DOESN'T

Believe me, I understand what you're saying.
Quick question - what's the difference between yours and Mom's income? Do you actually have a 50/50 timeshare?
