    Can I Get Joint Shared Parenting in the State of West Virginia
    My question involves a child custody case from the State of: West Virginia

    Someone just told me that in WV that shared joint custody is a given unless the dad is a complete waste of life. Is this true.
    I was already taken to court for child support but no visitation was set up because she was letting me have the minor child as much as I wanted to at that time. (I documented the days). But now after having gotten married she is refusing me any time fo no good reason. I just want to get visitation set up but if I could get joint custody would be a blessing. I miss my child so much & would like to see her ASAP but the court systems are quite slow. What to do?

    Joint legal custody is absolutely the norm (joint decision making), joint physical custody is not necessarily the norm. Unfortunately you HAVE to go through the courts if you want enforceable parenting time. So get going on it ASAP.

    Agree. Kids have two parents and courts support kids having viable relationships with both. Thus, joint legal custody along with a standard visitation plan is the norm, and the court deviates from that only when some special circumstance exists, such as health, safety, etc. However, with that said, the court doesn't IMPOSE visitation like it does child support - non-custodial parents who WANT an enforceable order need to ASK the court to order such. The downside of having a custodial parent who is willing to "play ball" and make you comfortable enough to not seek a court order, is that the minute they don't want to be accomodating anymore, you're up the creek without a paddle, or a court order - and yes, with the many hundereds or even thousands of cases in any given court in the country, getting such an order in place doesn't happen quickly. So there's light at the end of the tunnel for you on the visitation front, but you need to get that train rolling as soon as possible.
