Ending Joint Custody to Move to a Different State
My question involves a child custody case from the State of: Wisconsin
I have an 8 and 6 year old boy. Both have joint custody with other parent and primary physical placement with me. I just presented to the court of me wanting to move with the children 80 miles away from where they reside. What are my chances of winning? and what do I need to get prepared?

Custody determinations are made based upon the facts. The tiny amount of information you've shared so far works, on the whole, in your favor, but that's only about 10% of what a court might look at. What evidence can you present that the relocation is in the children's best interest? What will you do to ensure that the present parenting time schedule continues, or that an acceptable alternative schedule can be negotiated or ordered? Are you planning to provide transportation and/or cover the cost of transportation? Etc.

Thec relocation would be in the childs best interest due to a family structure. No more apartment and a positive and friendly neighborhood. The children would continue to have everything now and more including parks and lots of little kids that they have already been introduced to. They would be able to continue involvement and would be given more time than they would have now with their father. As far as transportstion im only moving approx 85 miles away so I would meet half way...does it sound like I would lose?

Why should he be responsible for any of the transportation because you choose to move 85 miles away? What does your current order say about transportation now?

Current order is he he picks up at the start of visitation and I pick up at the end of visitation

Yes, but you're creating an 85 mile difference - expect Dad to balk at that and request that you're responsible for all transportation.

So u think thats the only thing I have against me? How often does a judge say the children cant go with their mother. People move all the time

It depends.
Judges have to look at certain things. Are the benefits of the move going to outweigh no longer being geographically close to Dad?
The fact that you're essentially offering Dad even MORE time will certainly be in your favor.
