I Was Placed on Unpaid Leave Until I Won WC and then Terminated After ADA Request
My question involves labor and employment law for the state of: PA
A little complex - so I will be semi short. I was in work auto accident - was on orth restrictions but still working regular job. I needed surgery and just before I went out my manager changed my job description by adding lifting requirement - I am a white collar prof. I was placed on unpaid leave - I won WC. I requested a few month back to retun with accommodations from the TPA. I ddint get an answer back. i was recently terminiated - stated I was out for more than a year. I though when you request accommodations the employer must interact with you and not iignore the request. Can they legally change job description just before going out on leave? then ignore request so they can say you were on leave too long?
BTW - I just uncovered some corespondences between employer and TPA that were a prelude to this, they are over a year old but I just received them. It proves my employer was up to no good

Just for clarification - WERE you out over a year? Was the length of time affected by the change in job description?
