Drinking in Public or Open Container on Apartment Grounds
My question involves criminal law for the state of: SC.
The short version of the question is can someone be cited with violating either open container or drinking in public or public intoxication for drinking at an apartment pool.
(the posted rules include that no one shall use the pool under the influence of alcohol or drugs. Residents are permitted either 2 or 3 (it changes) visitors - which is also regularly violated as are many of the other posted rules including loud parties)
The repeated violations are disturbing other residents but the mgmt refuses to address the violations :wallbang:- despite posting and sending reminders. The local police mentioned finally that this will qualify as drinking in public. Can anyone verify?
(We rented based on the rules assuming a peaceful place to live.)

Private pool rules are not something that the police are going to enforce. You're going to have to beat on your land lord. There appears to be no provision against drinking on private property (even in the open air) that isn't a business.
