Lying to the Police About Driving During an Accident to Protect My Son
My question involves an injury that occurred in the state of: South Dakota
My son who is 15 and has a Learners permit (requires a parent to be with him) asked to drive to the store 2 blocks away. We let him and he decided to pickup 2 friends and going for a joy ride. He ended up rolling the car and totaling it. I went out to pick them up and my son and the 2 passengers they said they were all fine. We discussed with the parents about me taking the fall and so I told the cop I was driving. The next day one of the girls had a concussion and her grandma reported the crime. The other girl went in a couple of days later and had whiplash. When the officer stopped back at my house to question me I told her the truth. I reported the accident to the my insurance the day after that and gave them the truth and the names of the girls. What am I looking at for charges and how serious will it be? Are there more serious charges pending since there were injuries involved? I just wanted to protect my son to allow him to get his license I did not realize the severity of all this at the time. It has been 3 weeks now since the accident and there have not been any charges filed. The police office did say that I would be charged but did not say what I would be charged with.

Whether or not to charge you, and what the charge should be, will be up to the prosecutor. Browse through the criminal code, including the provisions on obstruction of government, and brainstorm.

What about leaving the scene of an accident can I be charged with that since I picked them up and then called and went back and lied. if so would that be a felony since one of the riders had a concussion.

i think that you did know the severity of the issues ... i think you have a problem with telling the truth
bye the bye ... the unlicensed kid would not have much done to him if the owner of the vehicle did not wish to pursue criminal charges ..
its not a crime, its an accident - a civil matter (sans the driving w/o a license if that's even a crime in your state)
now you could be charged with a felony ... if you will be, who knows...but you'll find out.
