Can Trustee and Guardianship Force Me Too Sell My House That I Received As a Gift
My Grandparent left half of their will too my father and my father brought my wife and i a house, a year later my father went too hospital and after not discharging him, they have got the trustee and guardianship too control his welfare and now their wanting the house he brought me so they can put him in a hostel, do they have the right to do that, i have rang a few hostels and because he is on a pension
it would not cost a lot and as from what i was told he had too have 100% care because i have a job they would not release my father too live with me yet the are putting him in a hostel which will be not the 100% care they are claiming he has too have, im thinking because he a really difficult person they are passing him off and wanting the funds from his house while he has money in his bank which they say they cant access? I dont know what too do as its a really hard position im in as i see it my father brought me a house i tryed too look after him and the hospital took charge and now the trustee and guardianship are forcing me too sell my family home by putting up a notice of caveat, asking me for the insurance information and today asking me too give them a set of keys,,,, What can i do.

Huh?
I am saying nobody here is going to be able to help you with Australian law. The laws of the US don't apply everywhere, as much as we would like them to.
Re: Can Trustee and Guardianship Force Me Too Sell My House That I Received As a Gift
From an american point of view very close to Australian law does differ but i first looked here because this forum seems too be quick with a starting brick from me meaning other people's point of view even from Americans :)
Re: Can Trustee and Guardianship Force Me Too Sell My House That I Received As a Gift
Because we have US laws in the US and you have Aussie law in Australia, anything said based on US law would be irrelevant. On top of that, we have 50 states, each with their own laws. So, which of the 50 states law would you want to attempt to apply to your situation in Australia only to realize, it is a meaningless effort.
Do you folks have some funky time zone issues? I went to check the time in Australia and it listed it as being 1:36 pm in Canberra and 3:06 pm in Kingston. You have half hour time zones?
Re: Can Trustee and Guardianship Force Me Too Sell My House That I Received As a Gift
I got another call from the trustee and guardianship people here told them where they stand and got some positive feedback from them hopefully they will stop trying too take my part of my inheritance and start looking after my father after all they did not release him to me because he needs 100% care where having a family and job was going to conflict too their point of view and chucking him into a hostel which i told them i'm against it if they end up putting him in one i will be taking them to court as they have caused a lot of pain and heart ache for my father for trapping him and me.
and I live 1 hour from canberre and its 1.54pm and its the same lol SA is 30min behind us and WA is 2 hours behind us

half hour time zones. What a pain in the rump that would be.
While the laws are different, issues dealing with situations like this seem to be universal. best of luck to ya.
