Completion of Deferred Probation Was Not Reported to the Court
My question involves criminal records for the state of: Florida
I had 2 misdemeanor charges in 2008 that ended with Adjudication Withheld and 2years of probation. After the probation was completed the DOC did not file any paperwork with the court to all the charges to be dismissed. I have had the DOC file the paperwork but now wonder how long it would take to get a judge to sign an order dismissing the charges and closing my case?
    Thanks!

Were these given as AW w/probation at the same time? They may not have been discharged because one was a violation of the other. Did you lie or withhold information?

It is unlikely that your probation has been held open for three years without anybody noticing. Have you verified the status of your case with the court, and verified that in the absence of proof of satisfactory completion of your probation the court didn't enter a conviction? Were both sentencing courts aware of the other charge and deferral when they sentenced you?

I have talked to the Clerk of the Court and there is no order showing that the charges were dropped after completion of probation. The final depo only shows the agreement for withholding adjudication and the probation sentencing. I need some kind of certified copy from the court showing that everything is completed.
    Thanks!
