Caught Stealing Food from a Grocery Store
My question involves criminal law for the state of: Oregon

Hello, I'm just a poor college student that has severely messed up. Forgot to sign up for fafsa and resorted to stealing hot foods at safeway. One day I got caught and I agreed to go in. I only stole $8 worth of food. Half pound of jojo's and a few chicken tenders. He said they will not escalate this case that far since I stole below $10. Now they have sent me a letter stating that I have to pay $256.84 (which I do not currently have) or they MAY escalate this case.

I have read multiple forums and I only have three days left to reply. I'm trying to contact the store owner to see if he will do anything since I read that they might dismiss it, then I would have to talk to the law office.

Also they didn't even spell my name right and have little to no information on me except a bad picture of me, my phone, and temp address (about to move our during the summer).

I feel like they have better cases to deal with than a petite case like this, but I can never assume.

Please tell me what I should and can do. Possibly of them disregarding this?

You should pay them, before the civil demand gets higher and they press criminal charges. Getting a job may sound like a novel idea, however, it is how many people in this country pay their bills.

apparently they have enough to have mailed you the demand for payment.

yes, do not assume. You will likely be proven wrong.

you should pay the civil demand. If you cannot pay it all right now, you best get on the phone and ask if there is a way to make payments on this.

what would their actions to date suggest?

If you don't make arrangements to pay the Civil Demand, there is a good chance they will go ahead and file the police report - the first step towards Criminal Charges, which will cost you a lot more money and give you a Criminal Record.

Time to grow up, be responsible (that includes filing the next FAFSA).

They said they may escalate this. They have enough info to send me the mail, but I'm not even in the lease.

What makes you think you have to be on the lease for them to find you through your address, regardless of temporary or permanent?

so, how did they contact you? Whether you are on the lease or not is irrelevant.

Okay irrelevant. They have contacted me through mail and tried to contact me through the phone, but I haven't had the chance to pick it up. Been struck with a fever. We haven't communicated yet, but on the letter it states they may escalate. I even called the store manager and he said he couldn't do anything.

I am also living in poverty. Will they actually sue me even though I have no assests to pay the legal fees and and court charges.

I have nothing to pay with at the moment.

It appears they will recognize you are ignoring them and it will be escalated. Not only will they likely sue you and tack on attorney fees to the civil suit, they could be pressing criminal charges and you will have a warrant for your arrest. You might as well stop wasting your money going to college, once you have the criminal conviction.

You are free to refrain from paying, and finding out if they sue you or if they refer your case for prosecution. We don't have a crystal ball - at least, not one that works.

They should not be saying, "Pay the civil demand or we'll prosecute," if that's what you're telling us; I'll comment more on that if you clarify.
