Missing a Deadline for Choosing a Summer Visitation Schedule
My question involves a child custody case from the State of: FL

The NCP was supposed to pick his summer weeks by May 1st. I am to pick mine by May 15th. The NCP has not notified me of the weeks he will be choosing. If he does not choose, why am I to do? Do I go ahead and pick my weeks on May 15th, without knowing his schedule? What if he decides later what weeks he would like? Does not choosing his summer weeks by the court appointed date mean that he will not get summer visitation?

I cannot read your order from where I'm sitting; but yes, if he doesn't identify his weeks by May 15 I would suggest promptly informing him of your chosen dates, ideally with his verifiably acknowledging receipt. Although policies can vary by court and depending on the terms of the order, ordinarily the court will allow you to pick when your time comes rather than keeping the custodial parent's summer plans in limbo because the other parent didn't meet a clear deadline.

I agree that you should get out your order and read it. However, most of the time that means that you get to pick your weeks, and then he has to work around the time you selected. He still gets vacation, he just doesn't get "first dibs" anymore.
