Re: Court for Petty Theft (Shop Lifting)
Well first offense of Petty Theft is good for up to six months in jail and up to $1000 fine (plus costs).
A diversion program would normally be available, but for an illegal visitor, it may not be offered.
A conviction of a misdemeanor wouldn't necessarily trigger deportation, but they certainly could hold you based on the overstay. How long have you been out of status?

I've never heard of any county offering that as a prerequisite, although as the programs can vary by county I can't speak for the nation.
