    My question involves personal property located in the State of: VA/SC/IL/IN

    Last summer while deployed overseas my father asked to use my boat. It was located/titled in SC in my name but registration had expired. I gave him a POA to title/register the boat in my name in VA (my current residence). He retrieved the boat and took it to boat in IN (he resides in IL). 2 weeks ago I asked for the boat back and he refused. Stated that he was going to re-title the boat in his name. I have a current VA title/registration in my name alone, along with a title for the trailer. There are no other active titles and the POA is revoked. I have contacted SC, VA, IL and IN police with little luck on how to retrieve my property.

    cops hate to get involved in situations where what was once permissive has now changed such as yours has. The biggest problem is; his use was permissive so arguing he has stolen the boat or otherwise illegally holding it becomes an argument.


    I would start with sending him a certified letter demanding the return of the boat and that he is no longer legally permitted to use or retain possession of the boat.


    Once you do that, I would file a report with the police in your state and contact the police in his state inquiring if you can file a report or institute charges.

    I will bet they all tell you to take care of it in civil court and that is likely where you will end up. You will have to sue him for the return of the boat or the value.
