Re: Marriage Not Finalized-Need to Leave State for Better Job Opportunity
I'm just weighing my options. If he has to put forth a lot of effort, I doubt he will even make a phone call & I'm just worrying over nothing. He hasn't even picked up a phone on his birthday or Christmas to wish him a happy holiday, I seriously doubt he'll make that much effort just to bring him back to Florida. See, his 1st child is 17, and he hasn't seen him since he was 7 months old. The mother took him back to NY and he has never attempted to reach her or his son. He continues to pay child support because he doesn't want to have to deal with the court system, or spend the money to get an attorney.
I will eventually find him befoer I leave and tell him where i'm taking him. I do think he has a right to "know" where his son is, I just dont think he should have any say-so over where that is if he doesn't want to support the child I have to do whatever it takes to make sure he's provided for. I can't make enough money here to support us both without living the rest of my life broke.
Do I just have to have proof that i told him 45 days prior to us leaving? If he doesn't file anything within a certain time frame, he won't be able to come back 2 yrs later and say I kidnapped my own son right? I would be fine flying back for a court date, as long as we don't have to come back and live here.
And if it's from the last time he's paid any child support it's been well over 2 years since he left and he hasn't paid a dime! There has to be some law out there that says something like, you stop supporting your child, or caring for his welfare, emotionally physically, medically that you surrender your right to call your self a father? I would swear sometimes that the laws are there to protect the criminals, not the innocent....this whole thing makes me sick to my stomach. He walks away yet I have to make sure he has rights to my son....

Can I ask if you're a Family Law Attorney in the State of Florida?
