Domestic Disturbance and Life Threating
My question involves criminal law for the state of: Texas
Our neighbors are always burning tire and driving down the street very fast. They have the music way above what you would consider loud. I always keep to myself and don't bother with those people.
Tonight for the third day in the row they burned tires passing by my car and my mother went to the door and told them to stop it. They left and another car drove up to their house. The music was very loud and my son was sleeping in the window right next to the noise. I waited a moment to see if they would lower it and then I went outside and asked them to please lower it down, that they weren't the only ones living in the neighborhood. They couldn't hear me because of the loud music so I said it louder. They still didn't reply back and my mother came out to also tell them to lower it down. The girl who lives there said that the guy was leaving, we were find with that, but the girl started to tell my mother things, insulting her and calling her names. I told her in a nice voice and tone that there was no reason to talk to my mom that way and that we only came out to ask them to lower the music. The woman in turn started to threaten me that she would in English translation (she speaks only spanish) that she would beat the heck out of me to the point that I couldn't stand and in an inch of my life. I moved away from my gate and moved to the door of my home. She moved towards my property and stopped next to my car saying she would beat me and my mom up and that she wasn't scared of me. The threats continued and I grabbed my phone from inside my home and called the cops. While on the call the woman and her family came to my property again at three different times while I was on the phone. She left before the cops came.
My question is besides them shoving it away as domestic disturbance, plus her threatening my life, is there something we can do? I am pushing for the cops to follow up on the threatening, I have never called the cops on anyone and never gotten in a fight. I have never broken the law or done anything illegal. If it came up to it I would defend myself, but I will not swoop to their level. I want the law to do the right thing and stop putting these people down as just domestic disturbance.
I probably should have recorded the incident so they could finally believe the truth and stop believing their lies. It was dark and nothing would come out so I didn't bother with it. If another incident does occur I will record it. And to top it off the people that were there weren't the ones causing the problem and they stated that the woman didn't live there, she does. Another thing, her threat which was said in Spanish also means that she would shoot me. I am a fair person so I explained to the cops that she meant beat me up to the point where it was life threatening.
Re: Domestic Disturbance and Life Threating
If the threatening conduct puts you in reasonable fear for your safety, you can explore the possibility of a protective order. An one-time shouting match over loud music... probably not the strongest basis for seeking such an order even if words were angry, but we weren't there.
