What Are My Chances of Getting an Acd for Shoplifting $450
My question involves criminal law for the state of: New York
Yes, I am one heck of an idiot. I am a 19 year old broke college student in New York City. I shoplifted approximately $450 from a clothing store.
I was arrested and I have an arraignment in 2-3 weeks. Since I am planning on going to graduate school and getting a PhD, I would love for my criminal
record to remain clean (should of thought of that before, I know. Like I said, I acted stupidly).
What are the chances that the judge will give me an Adjournment in Contemplation of Dismissal (ACD) so that I only have to do community service, pay the fines, and the whole thing can be as if it never happened?
I am willing to do as much community service as is required, but I really don't want this on my record.
Also, since I'm broke, do you guys think that I can get a public defender???

$450....not a first time shoplifter, but a first time being caught shoplifter. The dollar amount reflects that and will be taken into consideration by the prosecutor and judge.
You can get a public defender. Just remember there is a pay-back obligation.
You may want to talk to your parents. The store will be sending you a Civil Demand, and it will be atleast the amount of goods you attempted to steal, but can be a lot more. You'll need money to pay the Civil Demand. And if you get an ACD and Community Service - guess what, it is not free. You'll also have court costs and fines. Possibly an Anti-Shoplifting Class....guess what? You pay for that too.....
I'd try to get into Shoplifters Anonymous also.

It depends on the judge and da,having a good lawyer will help. Also if the charge is a misdemeanor you have a better shot at getting an acd but the amount of 450$ might make it hard to get an acd. Another option which isn't as good but will leave you with out a criminal record is a plea disorderly conduct which is a volition in ny state and not a crime. Also ask your lawyer about youthful offender status but I think you need to be 18 thou.
