Disorderly Conduct While Driving
My question involves criminal law for the state of: New York.
I was charged with disorderly conduct while driving. It happend when I was looking for parking by my building, I passed police veihcle and as I saw the spot I stopped and wanted police car to pass me on the left so I can park (it's a 90^ back in parking). Officer charged me with obstruction of veihcular traffic, even though I tried to explain my intentions, he said I cut in front of him and stopped suddenly and gave me the summons.
So I went to court, brought photos from the scene in hope to explain what happend and pleaded not guilty. But as I pleaded judge (his assistant) just handed adjournment slip to me for a new court date and said I can go to jail if found guilty then. What should I do now? Plead guilty at new court and go to jail for nothing?? It is all one big misunderstanding.
Thank you for your input.
Re: Disorderly Conduct While Driving
It appears your ability to represent yourself is somehow compromising your case. I suggest you hire a lawyer to attempt mitigation of damage.
Re: Disorderly Conduct While Driving
You passed the cruiser, then stopped in front of the police cruiser and waited for it to pass? How many seconds elapsed between your passing the cruiser and stopping in front of it? How many feet were you in front of the cruiser when you started to slow to a stop? Why didn't you simply follow the cruiser rather than passing it?
One would infer that you were either trying to argue your case at the arraignment, or you were so clearly bungling your defense that the court and prosecutor decided to give you a chance to get a lawyer and present a competent defense at an adjourned court hearing. One way or the other, your confusion suggests that you will benefit from being represented by a lawyer if you in fact attempt to go to trial on this charge.
Re: Disorderly Conduct While Driving
Yes, that's exactly what happened. It's been about 4-5 seconds and I stopped about 20-30 feet in front of their veihcle. The cruiser was moving with slower speed, looked like they were patroling, that's why I passed it.
