Duty of Towing Company to Document Authorization to Tow
My question involves a traffic citation from the state of: CA
(C) (i) When the vehicle owner or his or her agent claims the vehicle, the towing company prior to payment of a towing or storage charge shall provide a photocopy of the written authorization to the vehicle owner or the agent.
My question is if the towing company did not provide me with this, is this enough to win or can they just provide it afterward and not be affected by this.
Re: Meaning of This VC Section
providing a small excerpt from an unidentified statute and then not including the basis of your question is impossible to address. Explain the situation and provide the code section that is excerpted from.
Re: Meaning of This VC Section
My car got towed along with a friend's car and we believe it was not appropriate. We were towed for parking "after hours" but the sign says parking only during business hours, however we were at a crossaint shop that is opened 24 hours. The cars were parked near the yogurt place of that plaza and we walked up to there and realized it was closing despite numerous people and cars standing in the front probably just hanging out, therefore we decided to just walk to the crossaint shop on the end of the plaza strip. Walked out of the donut shop and did not see our cars. Called the police and they said call the towing company. Towing company said the cars were towed and they have it and it was towed around 12:10am. Went to towing company and they just handed a receipt, that's all. Im just looking at the VC section 22658. My friend came 2 days after to get his written authorization document but it took them 1 hr to get it, we believe it is faked but cant prove that. The document stated the time it was towed was 1240 which is ridiculous because we were calling the cops at 1230. And how is it possible to tow 2 cars at the same time with one tow truck using wheel lift and same driver? The vc section im looking at is 22658. Thanks.
