Would It Be Possible for Me to Get Emancipated
My question involves juvenile law in the State of: Texas.
I am currently 15 years old, and I will not turn 16 until 10 months from now.
I have had so many problems with my parents. We don't get along, we fight all the time, and there is so much emotional abuse going on. My mom has told me that she cant wait until I leave; my father has leukemia, and my mom is always telling me he's going to die prematurely because of me. I've attempted suicide twice, and I can't take it anymore. Child protective services has been to my house a few times, and almost removed my younger brother and I from our home, but things ended up changing because the physical abuse was minor.
I currently am somewhat self-employed, I guess, do transcriptions and make a good amount of money from that. I've saved almost every penny I've earned so far. I am in the process of trying to get a real job. I'm waiting to see if I can get a workers permit and find out who will hire at 15. I have found some places that do, and I'm going to apply for them soon.
I currently live with my parents, but I'm in the process of trying to move in with my grandmother. I know to be emancipated, you have to be able to support yourself without the help of anyone else and have a steady income before you can do anything, and I'm trying to save up to afford an apartment in the future.
I am doing online school(9th grade), and I will graduate in 2016.
However, I have been in a psychiatric ward in the past for self harm and a suicide attempt. I am currently on medication. Would a judge take this into consideration?
And is my reason even good enough to be considered for emancipation?
Thank you,
Adrienne
Re: Would It Be Possible for Me to Get Emancipated
I do not believe you will qualify for emancipation.
You're not already self-supporting; you're not already living outside the home. You have a history of psychiatric issues and suicide attempts. Add to that that you've basically only just turned 15 and there's no chance whatsoever.

In Texas you have to be 16 anyway, so if I was self supporting and outside of the home by then, would there be a chance?
Re: Would It Be Possible for Me to Get Emancipated
The court is going to look for any reason to deny an emancipation petition.
Addybug, emancipation is about need. It's intended for those minors who, through no fault of their own, have found themselves in a situation where they need (not want) the legal ability to sign contracts, to sign a lease, to get utilities switched in their name.
It has never been a means for an unhappy teen to leave home.
One look at your psych history would pretty much ensure your petition would be denied.
Re: Would It Be Possible for Me to Get Emancipated
Thank you for replying. I guess I will just have to find somewhere else to live until I turn 18.

Not without your parent/s permission, you won't.
Re: Would It Be Possible for Me to Get Emancipated
Again thank you.
I think what would be best now would be living with my grandmother for the next 3 years(with my parents permission of course).
Have a great day!

Sometimes, a loving relative is the best situation. I'm glad your family is working with you. Good Luck Addybug.
