I Can't Get Jobs Because of a Wrongful Conviction
My question involves criminal records for the state of: Ohio
What happened was when I was 18 my friends and I where out driving, there was 4 of us all together in my car. My one friend was however was 17 at the time a few months away from being 18. What happened is he hit a mail box and drove around for a bit after. We where then pulled over and I the owner of the car was arrested along with him. I went into court I asked them about my record they told me there would be nothing on there. Then about 8 years later I applied for a job and was told I have I will start on in so many weeks. Then a week before I was suppose to start work I got a call, and a letter that we wouldn't be able to proceed because of a misdemeanor on my record. To my shock I had to do a background check on myself. I then found I was denied other jobs due to this misdemeanor. So about 6 months had passed and I went to expunge it. I don't understand how all this law stuff works completely some in ends and outs. I thought I got this misdemeanor because I was the owner of the car. Any who I got a letter back from the court that they had expunged it and said I should have never ever been given this misdemeanor in the first place.
So my question is... Can I sue the court system due to lost compensation over the years, due to me not getting jobs. I do have it in writing from companies why I was denied and due to the mistake the court made. I found out I lost out on a lot of good jobs due to this. And these where close to 90 thousand a year jobs too.
Any help or pointers are appreciated. Also the only thing I have on my record is a few speeding tickets as of the current moment.

You're saying that more than one company was willing to pay someone with your grammar and spelling issues $90K per year?
And that several of these companies wrote to you and told you why they weren't hiring you and you didn't think to do anything about it until eight and a half years later?

My ex can't spell worth a damn....he needs a calculator to figure out a 15% tip....and he has a Masters Degree, Engineering the car you drive......and they pay him more than $90K....yep, that is possible.....

Spelling and grammar issues aside, I think the other point eerelations was making has merit.

No I didn't find out about till 8 years later. It didn't matter until I applied for a job of some importance. It was software engineering jobs. A lot of big companies don't care about your English as long as your communication is excellent. They have told me they don't care how its spelled long as you communicate clearly. Long as the idea has been executed correctly. ha yes I really didn't proof read I was in a rush. I would edit the title but it won't let me.
Anywho... Do I have a case?

haha yes thank you.. Some of my story... >I was 80% deaf for about 10 years of my life. So even though I was in the highest math class I was always in the lowest English class. But it has hurt me all the way through life, and still hurts me today. Just because I can't spell it correctly or speak it correctly doesn't mean I can't read it in my mind and have a complete understanding the word. :)

I can understand what he is saying. But when you truly don't understand a lot of the world works and how it really does work. one may make a decision like that. No offense taken. :) Take Stephen Hawking for example. If he knew nothing about him he wouldn't probably think to much if he just came up and tried to talk to him.

Do you have written affirmation from one or more companies that the SOLE reason you were not hired was due to this misdemeanor? Do you have verifiable confirmation of a wage that was withheld SOLELY due to this record and for NO other reason?

Yes I do have one from Robert Half Technology and another from Cleveland clinic. They both clearly state that due to the misdemeanor I am not eligible. I may have a email where they said everything was good to go and I was to start on so and so date. As for the wage I will have to check on that. I think I have a email or a pdf or some sort of screen print from the job ad. However RHT is by far no minimum wage job or even near that. :) Thank you and to everyone else for your support so far with this even eerelations.

Robert Half Technology is a staffing agency. At what point in the process was this? Were they putting you on their books to be placed or had they submitted you for consideration to a client?
And, how long ago was this?

The long and the short of it is, no, based upon the information you've shared so far it does not appear that you will be able to make a case out of this. You have chosen not to give us any material information about the incident, what happened in court, or the charge (beyond its being a misdemeanor), but from what you've told us so far you're going to walk straight into a sovereign immunity defense, and the statute of limitations is also likely to cut off most of your claims. Your damages are also speculative, and I very much doubt that your earnings history would support your claim that but for a misdemeanor people would be lining up to give you $90K jobs. If you want a full evaluation of your case, the details are very important, so get a copy of your court file and discuss the details with a lawyer.

Yes it was a one year contract with some hospital. Pretty much with RHT I was being hired by them. Directly by them. They told me after the year was over they would help me find something else. The way we had it worked out with them is I was going to be a employee with RHT.

Sorry I misunderstood the rules of the forum. I didn't know that I was suppose to share anything from the beginning its my fault I didn't read the rules. Yes and you are correct with my history working history. I was not making around $90 a year. I was making about 65 - 75 when I went to apply for it. I was working for a family company at the time. However I will gladly tell you more info. Also all I'm saying is if I wanted advice from a lawyer I would have went to one. I came on here to get advice from here, and people from here. This is a lawyer forum so my guess is people must know something on here. In other words when people talk about it everyday they must know something. The thought just came up in my mind and I really want the most amount of opinions that I can possibly get.

HEY!!! Whoever changed the title changed it incorrectly. :) I can get them now... This has been cleaned up. I received a letter from another judge who admitted there mistake. Actually I was just offered a decent job.....
My question is can I sue for the 8 years of my life that this was going on? Or just for the inconvenience till I found out and got a letter from another judge?
