Pregnant with My Boyfriend's Baby, but Still Married
My question involves a marriage in the state of: I am married but have been seperated since last summer. I am pregnant and due the end of the month with my boyfriends baby. My husband knows its not his. My question is can my bf sign the birth certificate? Oviously my husband wont be there to sign it. Can I leave part of it blank? and yes I filed for a dissultion in Ohio, I finally have enough money to pay for it...The baby is being born In Pennsylvania.....

In PA, the child born during a marriage is presumed to be the husband's child. You will have to have somebody contest the paternity of the husband and establish the biological father as the legal father.

and how would I do that? I mean my husband isnt going to be there to sign it so cant I leave it blank until my divorce is final in ohio then have the father added to it?

You'll leave it blank (and hubby still STILL legally be the father, until a court orders otherwise), and the biological father can bring a paternity suit in order to establish himself as the legal father. Have dad contact his local county court and ask for the Domestic Relations Office, or, for most counties, he can find information and court forms available on line (make sure he pays attention to get the right forms from the right county - they each have their own quirks about them).

well part of my dissultion in Ohio my husband is going to have to take a DNA test to "legally clear" that he isnt the father. So I am assuming my bf will still have to take a DNA test since the baby is being born in Pa to be added on the certificate?

If the presumption of paternity is disestablished in Ohio, your boyfriend will be eligible to sign an acknowledgment of paternity in Pennsylvania. Whether or not your boyfriend wants a DNA test before executing an acknowledgment of paternity is a personal choice. You can look at a sample form, or request a form, here; scroll down to the bottom.

Well I am still married. I am making my final payment so the paper work can get started. So could I still get the paternity establishment in pa? Eventually he is going to be on the birth certificate anyway when it's all final

I was hoping to do it as soon as possible. I'm just wanting to know if I'm allowed to leave it blank or have the bf sign it could there be problems down the road since my husband is the presumed father. I just can't see putting him on that to me is lying
