Name Removement from the DHS Central Registry
My question involves child abuse or neglect in the State of: Michigan
Hello, I wanted to find if the CPS/DHS has to give detailed reasoning of why they put yr name on central registry. My fiance was put on there for child abuse & Domestic Violence, but was never charged or convicted with the abuse. The words "child abuse" by definition under the "Childrens act" law has many variables. So im asking if they nd to be specific in reasons why they put my fiance on the central registry. She was put there merely by alligations from what CPS felt fit to use against her. Now the domestic violence she was charged & convicted of, which then she recieved 6 months probation and eventully let off early due to the P.O officer knowing the plaintiff was a lil out of control. Because of all this she/we cant be a care provider for her sisters (2) children.
Since she was never charged with any kind of abuse (as cps says) can we get her name off of the central registry without taking the necessary "protocol" steps of writing the letter to the supervisor who investgated her case. Everything was based on allegation, and your name doesnt go on there for a domestic violence.
I appreciate any help/answers to the regards.

The following can be found here http://www.michigan.gov/dhs/0,4562,7...9490--,00.html

Central Registry
Names of individuals are placed on the statewide Child Abuse and Neglect Central Registry if there is a preponderance of evidence that the individual has abused or neglected their child and the future risk to the child is high or intensive (based on the structured decision making risk assessment tool). Note: The Child Protection Law requires certain persons' names to go on Central Registry regardless on risk.
When names are placed on the Central Registry, the DHS sends each individual a written notification which includes:
Information on the individual's right to review the case record.
Information on the individual's right to appeal the decision to place their name on the Central Registry.
Instructions on how to file an appeal.
For information on how to obtain a central registry clearances, see the Central Registry Clearance Request page.
What are your rights?
You have a right to be notified that your name is being placed on Central Registry; this is called due process. You will receive a letter through certified mail or it will be hand delivered by the CPS worker. The letter will explain the following:
That your name is being listed on Central Registry and why.
Who can view your name on Central Registry.
What to do if you disagree with your name being listed on Central Registry.
What to do if you disagree with your name being listed on Central Registry.
Write a letter to the CPS worker's supervisor requesting that your name be taken off (expunged from) Central Registry.
Ask in writing for an Administrative Hearing to have your name taken off (expunged from) Central Registry.
She would have been notified when her name was put on central registry, she would have been given in that notice why. She would have been given in that notice her rights to appeal and instructions how to.
Not sure if she still can appeal. But according to this the other way would be writing a letter to the supervisor of the CPS worker who investigated the case or ask in writing for an Administrative Hearing to have your name taken off (expunged from) Central Registry.
