Passing on Left Through Parking Lane
My question involves a traffic ticket from the state ofCalifronia.
I was recently pulled over and given a ticket in California for illegal passing on left.
Traffic was at a complete standstill on a one-way street due to a parade in San Francisco and I planned to take a left hand turn at the next light to avoid the traffic jam. As I approached the light I made my way into the left hand parking lanes in order maake my turn. There were no cars in the parking lane and traffic was at a standstill so I deemed this safe.
As I pulled into the parking lanes passing through 3 spots, a cop pulled me over and cited me for moving violation v21750. Passing on left Parking Lane). In looking through the DMV book, I cannot find any specific violation that I broke. I am wondering if anyone thinks I can contest this ticket and what my chnaces would be.
Than ks,

Re: Passing on Left Through Parking Lane
The officer likely wrote you up for the wrong section. It would be almost impossible to interfere with stopped vehicles that did not intend to turn left at the same intersection by using an open curb parking zone. You, however did not make your turn from the proper lane, which is illegal.
Re: Passing on Left Through Parking Lane
You are free to appear in court and argue that there was no possibility any of the vehicles you were passing illegally through parking spaces were going to decide to park. Absent a written statement, confirming this suspicion, from the driver of every car you passed, expect to lose.

Overtake and Pass to Left
21750. The driver of a vehicle overtaking another vehicle or a bicycle proceeding in the same direction shall pass to the left at a safe distance without interfering with the safe operation of the overtaken vehicle or bicycle, subject to the limitations and exceptions hereinafter stated.
