    My question involves criminal law for the state of: Texas

    Hello, I have a few questions.

    First off, I am 17.

    March 8, around 11:30, I was pulled over and arrested.
    I didn't pull right over and the cop got on the speaker, telling me to pull over, but the light was red so I wasnt sure of what to do, so I pulled over to the other side of the intersection after it turned green. When I stopped, I threw one capsule of powdered heroin in the back seat, and in my purse was a needle, spoon and cottons. The cop got my friends and I to sit on the curb,
    took my cigarettes,ad found the heroin and paraphernalia, along with a one hitter pipe with k2 residue. When he asked whose heroin it was I admitted that It was mine. I was taken to jail and questioned, and I was completely cooperative and honest. y bail was set at 4000 when I was arraigned on Saturday morning, and was charged with possession of heroin. (I was arrested on a Friday night). So Sunday afternoon, a cop tells me that there was a glitch in the computer system, and they had to test the heroin, also that it could take up to 6 weeks
    Theres supposed to be a warrant out for my arrest, the charges have been dropped and I still have my license, I don't even show up online on the county arrests page. So I've been out of jail without bail since and haven't heard anything


    Could anyone tel me what action I should take from here or what I should expect regarding a sentence?

    Edit: the car is in my mothers name if that makes a difference

    Your case is likely sitting on the prosecutor’s desk, waiting for the test results to come back from the lab. Nothing is going to happen until those test results come back and that could take weeks or even months. But, I doubt that the charges have been “dropped.” This is just a lull in the process while the prosecutor gets all the ducks in a row. Once the prosecutor has the test results (presuming they are positive for heroin), then charges will be filed and you will be notified of when you next need to appear in court. If you already have an attorney of record, the notice may be sent to the attorney. Only if you fail to appear at your next scheduled court date would a warrant be issued for your arrest.

    As for what action you should take now…you need an attorney. If you already have an attorney, all your questions should be directed to him/her. Your attorney has access to your case file, the evidence against you, your prior history, etc., and is in a much better position to give accurate answers than anyone here. If you don’t already have one, find an attorney now. If you cannot afford an attorney, at your next court appearance you will have the opportunity to request a court appointed attorney to represent you.

    You need an attorney. And while waiting for the court date to be ordered, get yourself into a rehab program.

    17......Heroin and K2...You are a first time CAUGHT offender.

    You and/or your parents need to be calling around to lawyers TODAY. And to rehab facilities as well.

    You were busted with heroin at the age of 17, I'd say that no priors is an absolutely insignificant factor. At such a young age the judge will most likely seriously consider some sorta incarceration.

    And most would likely agree with him.

    If you do not get this 'lesson' learned this time, you are most definitely gonna be a re-offender!

    Another thing, don't know about Texas, but the vehicle can be impounded and forfeited for a drug offense.....regardless of who owns it.

    One of my postin' buddies already suggested rehab, but I'll go one further: Rehab and new friends!!! If you don't stop now, you never will!

    I was wondering about that...

    Heroin, spoon, needle, cottons...not your first time using...again, just your first time being caught. Any prosecutor or judge will know this.

    Again...LAWYER and REHAB.

    I am not one to lecture or judge but the bigger issue is stopping using that poison it's the path way to hell,it's especially sad that your using at such a young age. Given it's your 1st offense and your age I think you have a good chance at rehab and probation but if you get that even a little screw up afterwards and some time in jail is a very real possibility. I'm not sure if they have it but ask your lawyer about any diversion charges but at 17 your being charged as an adult. A conviction will be on your record for life,see what can be done to limit the damage. Most likely they're gonna retest the stuff and rearrest you in the future,time to find a good lawyer. Stay out of trouble you should be able to avoid getting sentenced to jail time but use this as chance to get clean,good luck .
