    Adding a Name to a Birth Certificate
    My question involves name change laws in the State of: california
    I am the only parent listed on my sons birth certificate. His
    biological father has not been involved since the day i was first pregnant. My son is 6 months old. I would like to add my fiance to the birth certificate. Also add my fiances last name to my sons.
    I have filed child support and will be in court this month. During my pregnancy i s
    tarted to date my best friend. He is "my sons father" we would like to add him
    To the birth certificate. Is this possible?
    Is it allowed if he is not biological father?
    Will it effect my existing child support order?

    So you want to put one man's name on the birth certificate but have a different man paying child support?

    You cannot do that - you would both be committing paternity fraud.

    Your son can only have one legal father. Pick one.

    I'll let Doggie address step parent adoption. She knows more about that than I do.

    However, I can tell you for certain sure, that you cannot get child support from a man who is not the legal father. If you put your fiance's name on the birth certificate and/or he adopts your son, then he is the legal father and you cannot and will not get child support from the bio father. If you are getting child support, from the bio father, then he is the legal father, he IS in the child's life (even if not in the way you would like), and you cannot and will not be allowed to put your fiance's name on the birth certificate and he will not be allowed to adopt him.

    Pick one. You do not get to have both.

    So get married, stay married, and then speak with an adoption attorney.

    Bear in mind if this happens, bio Dad will NOT be paying you child support. And nor should he.

    I actually never said I would still collect child support if my fiance adopted my son.
    Thats wasn't what I asked. I already know I can't receive child support and have him be adopted.
    I would rather him adopted and loved by a family who isn't ashaned of him then getting money from.a man he will never know and is embarrassed he has a son. I was simply asking when I get married if I can add his name to the birth certificate if he adopts my son. I feel like the comments are coming back rude. I'm definitely not trying to get money from one man and be with another. If my son is adopted we wouldnt want his money at all.Thanks anyway I'll figure out the rest on my own.

    No, that's NOT what you asked.

    Regardless, the answer remains the same. Your boyfriend/fiance/husband/whoever cannot at this point add his name to your child's birth certificate (paternity affidavit, at least) without you both knowingly committing fraud.
