Affair With a Married Woman Who Had My Child

My question involves a child custody case from the State of: Ohio. I began a relationship with a woman who was separated from her husband. She became pregnant. She went back to her husband and told him that he was the father. She left him again and came back to me and told me the child was mine. I raised the child her first 5 months. The woman then goes back to her husband taking the child and not letting me see the child at all. I requested a DNA test and the results came back today that I am the father. I do not know if I am going to be able to afford an attorney. Does anyone have any advice for me.

Was the test done through the courts?

The test was done through CSEA, we received the results today. The child will be 1 year old on May 25th. I spent the from 1 month old until Oct. When the woman took off on the eve of her husbands trial for Felony DV.

Okay - so does CSEA intend to establish you as father?

If that's the case, you have the right to file for an enforceable visitation plan, and you can (and should) request joint legal custody (decision-making).

I will have the DNA results in hand in approx 7 days. I was given paperwork to fill out for visitation. I do not know if I have to file separate forms for visitation and requesting joint custody. I would like to have full custody, and I do not know if a judge would look at her husbands DV convictions in considering custody.

This took place in Washington County. She told my mother that she was holding the child when the violence took place. My mother also has her accounts of the violence on her laptop, she uploaded them to her computer so she could read them.

Where would I go to find the proper forms to file for Full,custody, could I bargain myself for at least joint custody?

Unfortunately Washington Co is one of the few in Ohio which doesn't actually have forms online. I don't think once incident will be enough to strip Mom of her established custody though.

Joint custody simply means that both parents have some sort of physical custody.

If you're asking for a 50/50 timeshare, that's not likely at this point.

She left me and went back to him on the eve of his trial for felony domestic violence and she has a police documented case of attempting suicide. There is so much more evidnence. My mom said to file the myself prose,worried I would mess that up.

Again though, I see nothing that would cause custody to be taken from Mom.

File to establish an enforceable visitation plan first.
