Relocation and Change of Venue
My question involves a child custody case from the State of: Colorado
I am relocating to another state with my child whom I've had custody since she was very young. The mother of my child doesn't live in the city, county, or state where the case was originally filed and we currently live in a different city & county and we're moving out of state. How can I get a change of venue to the new state we'll be moving to.
Re: Relocation and Change of Venue
Once the child's domicile has been in the new state for six or more months, assuming no matters are pending before the court that issued the most recent custody order, you will bring a petition under the UCCJEA asking the new state to assume jurisdiction over custody matters.
If there's some reason you need an earlier ruling, you can consider bringing your motion before you move or explore the possibility of an earlier UCCJEA motion based upon the claim that neither of the parents nor the child have any remaining connection to the state that currently has jurisdiction, such that it might cede jurisdiction to the new state.
