Ex Wants More Child Support Than She Agreed to Accept
My question involves child support in the State of: California
I am currently going though a Divorce. I had a verbal agreement with my sons mother on Child Support before filing any divorce paper work. We first had the visitation hearing with a mediator. Then a court appointment with the judge. I thought we had an agreement on everything, but during the court appearance. She requested more money for Child Support. The judge gave us another court date - for Jan 2014!. She said she was going to give us time to come to an agreement. My question is - If I stop the child support payments until told by the court on what to pay. Can I get hit with back child support? I have copies of all the checks I've been giving her for over a year. Can I request to get that money back? Thanks for you service.

Would be a better idea if you just paid on the verbal agreement until its set. On time and with receipts. The court will look unfavorable upon you if you don't, as then it would appear you have harmed your child by being vindictive. Withholding it until the court or moderator makes a decision, will piss her off and the court will go in her favor. Plus back, maybe interest, and it will be harder to catch up. And you want to be on good terms with the mother, in case something trips you up, and need a slight break, she would be more willing to help as she will know you will make good later on.
