    Can a Court Order a Paternity Test if There's Another Man on Birth Certificate
    My question involves paternity law for the State of: California

    Can a man be court ordered to take a paternity test even though another man is on the birth
    Certificate for the past three and a half years? The father on the birth certificate has not paid child support since the the baby was born. Can the mother a paternity test for child support?

    Is/was Mom married to the guy on the birth certificate? Was there a divorce?

    Who is initiating the action? Why is Mom wanting to switch Daddies at this point?

    no, the mother never married. The mother is asking my bf to take a paternity test. Our bet is to get child support since the initial father has never paid child support. can she get a court order?

    Generally she's past the time in which she herself could challenge paternity, but if she can convince the court that there was a material mistake of fact the court might order your boyfriend to take a paternity test.
