Both Roommtes Charged With Simple Assault on Each Other
My question involves criminal law for the state of: North Carolina
Son's roommate(male) assaulted him & he ended up in the ER with a concussion. Son called police from ER, Officer could not locate roommate so told Son to go to Magistrate's office. Son went to Magistrate’s Office & requested an arrest warrant, which was issued. When roommate found out he took out warrant on my son. My Son never touched his roommate.
Son also requested and was granted a TRO.
Son is a full-time college student.
First court appearances are in 2 weeks. Their court cases are back to back, one on Monday the next on Tuesday.
Questions:
1. Does my son need an attorney for the charges that he filed? There are no actual witnesses. Someone did come in immediately after it happened. Roommate was extremely drunk & was shouting how my son would not even fight him. Roommate has had conversations with others since the incident that indicate that my son never touched him & that he only took out the warrant because my son had him arrested. There is also a prior incident where roommate struck son and there are witnesses to that. Roommate was also drunk in that incident.
2. Will my son be appointed an attorney for the charges filed against him? He has no real income and I am unemployed.

No, but he will want to discuss both cases with his criminal defense lawyer.

Your son can request a court-appointed lawyer. The rest is up to the court.
