    My question involves child support in the State of: Florida

    I have a Florida child support order that states that "the parties shall each be responsible for one-half (50%) of any and all medical expenses for the minor child not covered by said insurance. What falls under medical expenses (dental, ortho, vision, co-pays, prescriptions)? And what are the statue of limitations for collecting non-covered medical expenses? What is the proper way of requesting payment from non-custodan?

    My daughter just got braces and I put a down payment of $1000. Is that considered non-covered medical insurance? and if so what is the proper way requesting payment?

    There's no "set in stone" limit. Reasonable though might be, for example, sending the bill/EOB no later than 30 days after service, and requesting reimbursement to be paid no more than 30 days after that.

    My daughter had to get 4 teeth pulled, and I have been between dentist and orthodontist over the last few months. I wanted to wait to get all bills from the whole procedure before asking for 50%. I am still waiting for a bill. Would 60 days be reasonable, if I offer him 60 days to pay me back?

    Some people might think that's pushing the envelope a bit, but I don't see why it shouldn't be okay.

    Have you talked to the other parent about it?

    Hang on -when you say "past few months", what are we talking about? If she had something done in November, for example, not sending the bill until now is not reasonable.

    No, I haven't ask him to reimburse me for any medical expenses ever, and my daughter will be 11. It has been a big struggle over the past 10 years getting FL Dept. of Rev to enforce my child support, and fighting him to pay me for non-covered medical expenses would be a lot more stress with little outcome. The more pressure I put on him to pay child support the less he is communicating and having a relationship with my daughter, their relationship has meant more to me then money. I realize now that I am paying a price for their relationship (which is non-exsistant anyway) and I have really put myself in debt, when I should have been submitting the non-covered medical expenses to him over the last 10 years. So I am done playing the "victim" and am taking responsibility. I am not suggesting that I am going to go back 10 years and request he pay me for the non-covered medical expenses.

    She started the whole procedure between the dentist and orthodontist on 2/14.

    Some parents are just going to be deadbeats, in the financial sense. There's little that can be done if a parent is truly intent on not paying up.

    So, start afresh. If you have 3 months' worth, send them, and request reimbursement within 2 months. After that, as soon as you get the bill/EOB, send it immediately and request reimbursement within 30 days.

    If the other parent doesn't pay up, you go to court and file a petition asking that the parent be held in contempt for willful non-payment.

    Oh, she only started in Feb? Then you'll be FINE. Send the bills, and make your request.
