That being said (and I agree that there are some states that allow for this argument ... even if it might not work), I doubt that any court is really going to buy that an 18-year-old and a 12-year-old have so much in common that he could not tell in two minutes that she was not a high school student. My guess is that he is toast ... or, more likely, that we are being played.

Yeah, but they don't tend to brag about committing felonies. And they can sometimes keep a secret. More importantly, their friends are not as open about repeating something they know will get them or their friends in trouble. Identified suspect or not, a pregnant tweener will generate police attention. So, if the OP has NOT been identified, then I strongly suspect he is NOT hanging around as he claims and is NOT providing for the girl and her child. As such, I strongly suspect that this is bogus or he is actively on the run avoiding the law.

Yep. The criminal statute reads "any PERSON who...." - it doesn't distinguish between genders. Any PERSON at or above the statutorily designated age who has sex with another PERSON who is under the age of consent faces the same criminal penalties.

And please, for the sake of the volunteers, don't start paying the "..but what if.." game.

Why am I suddenly suspicious that we have just been given the reason this thread exists in the first place?

Yea I'm a girl . But would I really get in trouble if he have my son his last name? Because he's only 15.
