The nice thing is the statute of limitations for your prosecution does not start until she is 18. Your child will be a teenager before you get a walk on statutory rape. Sucks to be a sexual predator doesn't it? Here is your crime. Mom can be charged also, since she is aiding and abetting the escape of her daughters rapist.

It doesn't matter whether the child you raped wants you in jail or not. That's up to the DA. I am extremely sorry to tell you that there is a three year statute of limitations on the felony you committed when, as a legal adult, you had sex with a 13 year old. I sincerely hope that you are charged and sentenced to the maximum possible penalty before the SOL runs out.

it is not up to the daughter or mother to press charges. The state would do that all on their own, if they chose to.
If I am not mistaken, the state has until the mother of your child is 28 to prosecute the crimes.
What is really neat about this, is mom n daughter are probably committing welfare fraud to protect OP. So they are in even more trouble.
Her mother is and was aware of the dating and everything that has gone on till this point.
Then Mom can (and should) go to jail right along with you.
I'm going to give you a clue here. With the possible exception of john, who doesn't know beans about the law, you're not going to find anyone here supporting your position. Yes, right now you have a choice; you can "give the child your name" (translation - make sure everyone in the world knows that I have a functional reproductive system and am too horny to keep it leased even if it means committing a felony) and potentially go to big-boy prison, or you can leave well enough alone and hope that you can skate along under the radar until the SOL runs out.
And if Mom knew and approved of what was happening, there are charges that can be filed against her as well.
