    Invited Into House Yet Charged With Burglary
    My question involves criminal law for the state of: Virginia, I was at my girlfriends house whose parents and family do not like me and they didn't want me to be eating their food or anything while I was there or she would get in trouble if they saw. But while they were out and my girlfriend was sleep I went downstairs to get something to eat because I was real hungry. and when i got down there i saw her mom and sister coming to the door and the way i was positioned i couldn't go back upstairs my only choice was downstairs to hide. when i got downstairs the laundry door was locked so i went into her parents room because i was going to leave out the back door and get on the bus as if i was never there. but when i was going to leave i realized i left my money for the bus and my phone up in her room so i looked around for change that i could grab and hurry and go and i saw a piggy bank so i grabbed it and opened it and her mom was coming so i just left it there and ran into the bathroom and hid in the shower. and her mom was using the bathroom and pulled the curtain back and saw me and screamed to her sister to call the police. so now they are accusing me of breaking and entering and robbery because they don't know i was already in the house. and they think i took some change. i never actually got to take any because she came as soon as i opened it.

    Speak with an attorney and expect the parents to obtain a restraining order against you at the very least.

    Charges of B/E or robbery aren't likely to go anywhere. Whether they like it or not, they left their daughter "in charge" of the house, unsupervised, and she allowed you into the home and argueably could have offered you food or beverage. Prosecutors don't often prosecute people who were invited in, even if it pisses off the parents. However, their daughter had NO lawful ability to permit you to take or attempt to take property belonging exclusively to the parents, so you're potentially still on the hook regarding the piggy bank. You don't have to have successfully made off with the goods to be charged with the attempt. Just ask all the people at WalMart who get arrested just for putting an item in a pocket or under a shirt, and never made it out of the store before being arrested. And, you can expect at the very LEAST they'll seek a restraining order on behalf of their daughter. They can absolutely prohibit your contact with HER, and can effectively prohibit contact with the child unless you've got a custody order to the contrary. With a custody order, they may be compelled to allow visitation with your child. But they can virtually lock their daughter in a tower away from you if they choose to do so.
