    Chances of getting a deferred adjudication
    I recently got caught shoplifting at Target (total of $75). I also have a previous record of misdemeanor theft from back in 1999, where I was granted deferred adjudication/probation and paid a fine. I live in Texas. Given the fact that I've been charged, but not convicted, of the same crime before.....my question is....what are the chances of of me getting jail time?? Will I be able to get deferred adjudication again?? Also, do I have any options if I want to keep this off my record?? PLEASE HELP!

    Getting a second deferment? It's hard to predict. The odds are significantly reduced by the prior, particularly if it's the same county. You should consult a criminal defense lawyer.

    It's actually in a different county. Does that make a difference?
