    Reentry on VWP After a Prior Overstay
    hi there

    10 odd years ago, i visited the US via the vwp; i however went 3 months passed the 90 allowed day, i never got deported or anything simply left of my own choice. I shortly be visiting the US again to visit some friends and do not intent to overstay the 90 days . i applied for an esta and they granted it Does that mean that my silly error of 2003 is not on record? will i be allowed to enter the States?

    You'll find out when you attempt to enter. The granting of ESTA suggests that you may have squeaked through the cracks, but nobody here can promise that your past overstay won't catch up with you - and you obviously already know that, if detected, it renders you ineligible for VWP.

    thak you very much, lets assume they refuse me entry as i will be coming from canada ( start of my vacation) would they send me back to europe or canada cos if worst comes to the worst i rather finish my holidays in canada. but would canada let me back in knowing that the us refused me access?

    U.S. immigration laws do not apply to Canada. Overstaying VWP has no relevance to whether or not you can lawfully enter Canada.
