    When Can the Police Check on the Welfare of a Child
    My question involves police conduct in the State of: Montana
    Do you have to let the police in your house if they show up to do a welfare check on the kids? Or can you just bring the kids to the door for them to see that they are safe and refuse to allow them in your house? The reason I ask is because my husbands ex wife has been on a rampage lately. He has custody of the kids 50% of the time and the parenting plan states he is not to drink alcohol to the point of intoxication while the kids are with him, nothing that says he can't have a few beers. Last weekend she called them to do a welfare check alleging he was drunk, an officer showed up, we let him in, he talked to my husband, talked to the kids, then left. 4 hours later after we were already in bed, 3 more cops came back to get the kids because the 1st time the cop was here he claims he observed my husband was intoxicated and there were 4 beer cans in the trash can. My husband was actually NOT intoxicated, and the cops didn't give him ANY kind of sobriety tests or BAC tests, the 1st officer just claims he could tell in his eyes that he was drunk, and he saw the beer cans in the trash. So next week when the kids come back we suspect we will be getting another visit....after the way things went last time we are very reluctant to even let them in the house or talk to my husband for fear they will pull the same BS.

    How do you think it's going to look if you refuse to let the cops into your house? It's going to look like you have something to hide.

    Just to give him an idea of what is an appropriate amount of alcohol and what is not. Generally, four beers in one day is pushing it. Many psychologists consider 14 drinks or more a week to be a sign of alcoholism.

    Since there was no blood alcohol test, it is your word against the cop's word as to the intoxication state of your husband that night.
