Sell Damaged Car or Wait for Police Report
I just moved to Florida from Illinois. I officially started renting a house yesterday. Accident as explained by a witness: http://www.youtube.com/watch?v=LLbe4IWN-mk
The other driver was adamant that he was not moving at the time of the accident- that would clear him of all error if it were true. My error was that once he had passed my car in the full portion of the lot I assumed he would continue to go straight in the right hand lane. I checked my left shoulder and as I checked my right shoulder I saw him reversing and was not able to hit the breaks fast enough.
Insurance will likely say it was 50/50 based on the reviews of what people are saying online.
I have ten days till the car will be illegal with out of state plates. I get the report in 8 days. I'd like to sell the car. That was the plan before, but now I'm not sure. Should I wait for the police report?
Re: Sell Damaged Car or Wait for Police Report
actually, the other vehicle reversing would not necessarily remove all possible responsibility on your part. It might but without more information, it doesn't necessarily do such.
You really should edit out the name and phone number of your witness. I'm betting he would not like a flood of phone calls due to his desire to be helpful.
If you are considering making a claim for damages from the other driver, selling it now might be a problem as the other party's lawyer or insurance company may need to be able to inspect the vehicle. If you are not planning to make a claim for damages, I would not think it would make much difference as the damage really cannot prove the facts in question in the case. Get a lot of pictures of your car and an estimate of the damages prior to selling it.

It sounds like he was clearly in control of the lane of travel and you backed into him, from the parking space. Though it will likely be solved 50/50, you appear to be more at fault.
